Findings and Concerns: Casey and Anthony provided great insights into their current cleaning arrangements and requirements.  A walk-through inspection of the premises was done with the help of Anthony. Current cleaners have overlooked dusting and so many other basic cleaning tasks. When we carried out a necessary inspection, we found the following issues, which we would like to bring to your attention.

    1. Entrance window is dirty and needs a deep cleaning.
    2. All the ledges, windowsills, and desks are full of dust and stains, requiring dusting and disinfection. 
    3. Marks on the glass panels and walls.
    4. Bathroom walls have lots of stains and marks ( moping splash marks).
    5. Toilet sinks, and surrounding areas have stains. Handrails need cleaning and shine. 
    6. Huge amount of dust is accumulated on the toilets doors, partition tops, and surroundings.
    7. Tiled floors in toilets and hallway are poorly maintained, with lots of visible marks and stains. Needs good scrubbing and deep cleaning.

Overall cleanliness of the premises is way below our minimum standards. Anthony’s main concerns and frustration were that the cleaning service was being paid for without being achieved and consistently substandard. Also, the current cleaning provider has breached security arrangements several times. Taking these issues into consideration, we have developed a tailored cleaning plan, starting with an initial deep clean, then – focusing on dust elimination and overall presentation with maintaining a higher cleaning standard.

1) Quotation Terms and Conditions

    • The price includes labour, chemicals, cleaning equipment, and tools.
    • This price is fixed for a year, and this is to increase by 5% on each rollover.
    • No service is provided on public holidays. If a public holiday falls on the day of cleaning, then cleaning will be rescheduled either day before or after.
    • Client is to provide all the toilet supplies.

    • The service will be provided in a faithful, timely, and professional manner.

General Terms & Conditions

Terms and Conditions of the Service

  1. Services
    • ‘Services’ means the commercial cleaning services mentioned in the quote and provided by Xlent Cleaning.
    • ‘We’, ‘Us’, and ‘Our’ refer to Xlent Cleaning and its services.
    •  ‘Client’ and ‘Customer’ refer to anyone who uses Xlent Cleaning
    • ‘Party’ and ‘Parties’ refer to the client and Xlent Cleaning when referred to collectively.
    • Any services are subject to the terms of the Service Agreement. Xlent Cleaning agrees to provide cleaning services (the “Service”) to the customer at an address specified by the customer (the “Premises”).
    • The Service task will be such cleaning duties provided in the Scope of Works.
    • The term of cleaning service engagement is for one year, with automatic rollover for a further year.
    • Xlent Cleaning is committed to providing services in a faithful, timely, and professional manner.
    • Supplies will be provided by the client or Xlent Cleaning, as agreed and mentioned in the quote.
    • Xlent Cleaning will provide cleaners (the “cleaner”) as required to attend the premises to provide the service at a time and date mutually agreed between clients and Xlent Cleaning.
    • Performance of service is to be carried out by Xlent Cleaning staff. Xlent Cleaning is an independent contractor and not an employee of the Client.
    • Xlent Cleaning reserves the right to allocate staff and design and implement working arrangements.
    • The Xlent Cleaning 100% money-back guarantee means clients will receive money back if they are entirely unsatisfied with the outcome and results. However, if clients are not satisfied with the part of the job, it will be re-done at no extra cost.
    • The yearly free offers will be carried out if the client agrees to renew the contract for a further year.

 

  1. Service Quotation
    • All prices quoted are unless expressly stated otherwise, exclusive of GST.
    • The quotation price is fixed for a year, and this is to increase by 5% on each rollover.
    • We may need a price review before the expiration of a contract term if market trends, labor costs, or other market forces are likely to affect prices. The client may either accept or reject the revised prices.
    • If the Client does not accept the price changes, then enough notice will be provided to terminate the services.

 

  1. Payment Terms
    • Invoice will be issued fortnightly. Where Xlent Cleaning has agreed to invoice the client for payment of fees after the service has been completed, the client agrees to pay in full all fees due within seven days of the invoice date.
    • Payments can be made via credit card, bank transfer, and cheque. Bank details will be provided on the invoice.
    • An administration fee of $ 10.0 for late payments will be charged on overdue accounts.

 

  1. Additions and Amendments
    • Any changes to services, whether once-off or regular, must be agreed upon by Xlent Cleaning before the service is carried out.
    • Clients are not permitted to request additional tasks with our staff without Xlent Cleaning’s approval. Staff is not authorized to carry out duties other than the regular scope of works.
    • Any request for changes by the clients to the Agreement must be made in writing. When such a request has been made, Xlent Cleaning has the right to review and alter the quotation price.
    • If clients require changes to cleaning time, they must notify Xlent Cleaning a week in advance. Differences in timing (Such as after-hours and weekends) might constitute changes to the price.

 

  1. Access to the Property
    • The client must provide access to the property where the service/s will be performed. The client can choose to be present at the cleaning time or assign keys/swap cards/fobes/alarm codes to Xlent Cleaning for access. Assigned keys/swap cards/fobes/alarm codes will be treated with utmost care.
    • We request the client to provide two sets of keys/swap cards/fobes. If two sets are not provided, Xlent Cleaning needs to make a duplicate copy, if permissible, and keep them in our office in a secure locker. Our managers and supervisors will use these copied items to access the property for inspection.
    • If such copies are made, the client will be notified and provided with details of copied items.
    • Lost keys (if happens) will be reported to the client promptly. The client might want to replace the lock or cancel access to the lost swap cards/fobes. Xlent Cleaning compensates any cost incurred due to this event.
    • Upon termination of the cleaning service, all original keys/swap cards/fobes, including duplicate items, will be returned to the client.
    • Water and electricity must be accessible within the property where the service/s is to be carried out. Failure to provide these may cause the service to cancel.
    • Client must provide enough room or secure space to store the cleaning equipment and products. No restriction should be made to hang or stick our guidance and other documents containing information against walls.
    • The keys must not use to access the property other than the days performing cleaning services. If access is required for some other reasons, Xlent Cleaning must take the client’s permission.

 

  1. Health and Safety
    • While Xlent Cleaning makes every effort to provide a safe work environment, clients must provide information in advance about potential hazards associated with the premises.
    • Clients must inform Xlent Cleaning if the subsequent risk has been identified and poses a threat to health and safety.
    • The client should, wherever possible, be involved in conducting risk assessments and developing solutions.
    • Both parties must comply with the Work Health and Safety Act 2011 and any other workplace health safety requirements and provide resources to maintain a safe workplace and continuously improve health and safety.

 

  1. Privacy and Confidentiality
    • Both parties must comply with the Australian Privacy Act 1988 (Cth) when handling all personal and business information.
    • Both the client and Xlent Cleaning must keep all confidential information in strict confidence and use it solely for the purpose.
    • All personal and business information collected during the service period must be treated with utmost security and confidentiality.

 

  1. Insurance
    • The contractor ( The Xlent Cleaning) must maintain adequate insurance and provide relevant policy documents to the Client.

 

  1. Damage, Breakage, Accidents, & Theft
    • Clients must inform Xlent Cleaning of any incident where an accident, breakage, damage to property, or theft has occurred due to any act of Xlent Cleaning staff within 24 hours of completion of the service.
    •  In a case of damage and breakage proven to be caused by Xlent Cleaning staff, the company will either repair the item or, if the item cannot be repaired, the company will compensate the client with the item’s fair value.
    • If case theft is proven, Xlent Cleaning will take legal action against the person involved, and the client will be compensated with the item’s fair value.

 

  1. Complaints Resolution
    • Any issues with the service must be reported to Xlent Cleaning within 24 hours. The client must provide (photos and videos) of unsatisfactory cleaning within 24 hours of completion.
    • Xlent Cleaning will use reasonable endeavours to resolve complaints. All complaints are handled and resolved fairly and transparently according to Xlent Cleaning’s complaints handling policy.
    • Failing to report to Xlent Cleaning within a reasonable period may affect compensation.

 

  1. Respect in the Workplace
    • The client and Xlent Cleaning must engage respectfully, honestly, professionally, and fairly in all dealings.
    • Each party must treat the other party’s employees with respect and dignity.
    • Each party must be committed to providing an environment free from discrimination and harassment based on race, color, religious creed, national origin, age, sex, marital status, or other basis protected by law.

 

  1. Termination of Service

Termination by Xlent Cleaning

    • Failure to make payments – A written cancellation notice will be given if the client fails to make payments for more than two consecutive payments. A reasonable time frame will be provided for the cancellation to come into effect.
    • Non-compliance with agreements – If the client continuously breaches an essential agreement term, then Xlent Cleaning may terminate the contract by giving written notice.
    • Activities of clients: If the activities pose a serious risk to the health and safety of Xlent Cleaning staff, and the client is unwilling to minimize the risk to an acceptable level, Xlent Cleaning may terminate the service immediately.
    • Not willing to accept reasonable amendments due to changing market conditions – We may need a price review before the expiration of a year‐long contract if market trends, labor costs, or other market forces are likely to affect prices. The client may either accept or reject the revised prices.

 

Termination by Client

    • Not satisfied with the performance of Xlent Cleaning: If Xlent Cleaning services fail to satisfy clients, they may seek to terminate any agreement. The client must give four weeks’ notice for cancellation.
    • Breach of service agreement by Xlent Cleaning: If Xlent Cleaning fails to comply with a service agreement, clients may terminate immediately.
    • Changes of mind or circumstances: clients may terminate service if their circumstances change. Four weeks’ notice for cancellation must be given.

 

  1. General Provisions
    • If any provision, clause, or application of these Terms and Conditions is found by any court, tribunal, administrative body, or authority of competent jurisdiction to be illegal, invalid, or unenforceable, then that provision will be ineffective
    • Any provision of, or the application of any provision of, these Terms which is void, illegal, or unenforceable in any jurisdiction does not affect any other provisions of these terms and conditions which will remain in full force and effect.
    • Client will be deemed to have accepted the terms and conditions of our service if they wish to use our service.

We shall capture photos and take video clips before, during and after the cleaning job(s). This will include just the cleaning area, but not the secret or private sections, area and information of the Client. Xlent Cleaning will use the captured/recorded materials only for official purposes – planning cleaning tasks, performing, addressing complaints, collecting testimonials, improving the services, and informing about the changes or updates.

If those captured resources are to be made public via the website, social sites or used for other purposes, the prior consent will be taken from the Client.

5. Access to personal information and correction

Individuals may request access to their personal information held by Xlent Cleaning, and if they believe it is inaccurate or incorrect, they may ask for it to be corrected. We will provide access to personal information as quickly as possible.

6. Duration – how long we keep information

Xlent Cleaning only retains personal information for as long as it is necessary for the purposes it is submitted. Unless required or permitted by law (such as tax, accounting or other legal requirements), we do not hold any personal information after partnerships or relationships end, and all personal information is securely disposed of in accordance with industry best practice.

Multix Services Pty Ltd T/A Xlent Cleaning is committed to providing and maintaining a safe and healthy workplace for its employees, clients, visitors and anyone else who may be affected by its business operations. We comply with the Work Health and Safety Act 2011, and provide resources to maintain a safe workplace and continuously improve health and safety.

Intent of this policy

The intent of this policy is to ensure:

    1. work health and safety (WHS) is an integral part and at the core of the way Xlent Cleaning operates;
    2. compliance with all applicable federal and state legislation;
    3. effectively implementing a best practice work health and safety system to eliminate or minimise the risks, so far as is reasonably practicable, to the health and safety of everyone involved in or may be affected by business activities; and

Responsibilities

Responsibility for managing health and safety ultimately rests with the Xlent Cleaning Managing Director. Importantly, workplace health and safety is a shared responsibility, and every member of staff has a role in keeping themselves and their workplaces healthy and safe. Managers and supervisors are responsible within their scope of authority to implement work health and safety policies, procedures and practices.

The goal of Xlent Cleaning is to provide a safe and healthy work environment free from workplace injury and illness. This can only be achieved through the active participation, cooperation and commitment of everyone in the workplace.
